Woman in double marriage goes missing, claims father

Family court nullifies marriage, grants divorce to both husbands

By Adnan Al-Shabrawi Okaz/Saudi Gazette JEDDAH — A father who was accused of marrying off his daughter to two different suitors at the same time has claimed that his daughter went missing after both of her husbands filed for divorce. The men filed divorce petitions at the Personal Status Court in Jeddah on Monday. They had previously filed lawsuits against the 50-year-old father for allegedly deceiving them by giving his daughter in marriage to both of them simultaneously. The court nullified the marriage and granted both men divorce. It said the woman reserved the right to sue her father for committing the heinous crime of marrying off his already married daughter. The father insisted that his daughter was divorced by her first husband after 10 days of marriage. However, the court rejected the father's claims saying the two marriage contracts ratified by marriage officiators were sufficient proof against him. The second marriage contract wrongly stated that the woman had not been married previously. The father made his defense by claiming that he had ignored the fact that his daughter was a divorcee because her previous marriage was very brief. He said he had informed the marriage officiator later that his daughter was in fact a divorcee, but he forgot to amend the marriage contract. The prosecution cross-examined both husbands, marriage officiators and the father. The father’s statements were not corroborated by the others. The prosecution argued that the father had a financial dispute with his daughter's first husband and therefore his motive in marrying her off a second time could have possibly been making financial gains from her dowry. The prosecution summonsed the woman to question her and to hear her side of the story but the father said his daughter had been missing. The woman's first husband said he and his wife lived together for two months. When the husband had to move to a suburban area of Jeddah governorate on work-related matters, the couple agreed that the wife would stay with her parents until his return. When the first husband heard about the woman's remarriage without him divorcing her, he got in touch with his wife's new husband to find out the facts. During his absence, the father married her off to another man who had also proposed to her. The second husband was not aware that the she was previously married but he later found out from his bride that she was still married to a relative of hers.
