Mary Trump's publisher gets court to lift order blocking book

July 03, 2020

NEW YORK — A New York appeals court cleared the way late on Wednesday for a publisher to resume distribution to booksellers of a tell-all book by Donald Trump’s niece, Mary Trump, despite the objections of the president’s brother.

The New York state supreme court appellate division said it was lifting a temporary restraint that a judge put on Simon & Schuster a day earlier that sought to block distribution of Too Much and Never Enough: How My Family Created the World’s Most Dangerous Man, The Guardian newspaper reported.

Although the book was scheduled to be published on July 28, Simon & Schuster said thousands of copies of the 75,000-copy first run of the book had already been sent to bookstores and others.

The appeals ruling, written by Judge Alan Scheinkman, left in place restraints against Mary Trump, the book’s author and the president’s niece, at least until a hearing due on July 10.

Attorneys for President Donald Trump’s niece and her publisher filed separate notices of appeal Tuesday afternoon after a New York State trial judge halted the publication of the niece’s promised tell-all book about the Trump family.

Dutchess County Supreme Court Judge Hal B. Greenwald earlier Tuesday agreed to a preliminary injunction against niece Mary and publisher Simon & Schuster. The judge’s order basically forbids the publishing of the book or the leaking any of its contents pending further judicial proceedings.

The first notice of appeal, filed by Simon & Schuster cites the issue, as the attorneys state it, is “[w]hether the [trial judge’s] Order constitutes an unconstitutional prior restraint of Simon & Schuster’s rights under the First Amendment of the United States Constitution and Article I, Section 8 of the New York Constitution.”

The second notice of appeal, filed by Mary L. Trump reads virtually identically but adds the issue of whether Robert S. Trump “has satisfied his burden to establish the factors of a temporary restraining order.”

Robert Trump, the president’s brother, had sued Mary Trump to block publication of a book promoted to contain an “insider’s perspective” of “countless holiday meals”, “family interactions“ and “family events”.

Robert Trump has said the scheduled July 28 release of “Too Much and Never Enough: How My Family Created the World’s Most Dangerous Man” would violate a confidentiality agreement tied to the estate of his father Fred Trump Sr, who died in 1999. — Agencies
