Bereaved Saudi husband wants doctor punished for fatal medical mistake

JEDDAH — Like any other expecting mother, Anwar, a 29-year-old Saudi woman, dreamed of having a baby to fill her life with joy and happiness and to wake her up in the middle of the night to be breastfed.

Her dream was shattered forever. The woman died of a medical error leaving behind a devastated husband who says he wants his wife back, not any diyah or blood money.

Saleh Al-Qabdah, the bereaved husband, said the concerned authorities held the doctor, who was treating her, 100 percent responsible for the medical mistake and his wife’s subsequent death.

“I am not waiting for financial compensation for the unexpected departure of my wife. I want justice from the doctor who turned my life into an extended darkness after the death of the closest person to my heart,” he said.

Amid tears and a shaking voice, Al-Qabdah said his wife was under the process of having a test-tube baby when she suffered three strokes that ended her life prematurely.

He said he complained about the medial error to the Forensic Medical Committee at the General Court in Jeddah to settle the case.

He said after 13 years of marriage without babies he and his wife decided to go for a test-tube baby so they went to a famous clinic in Jeddah specialized in the treatment of infertility.

“The consultant gynecologist gave my wife injections which he said would activate and enlarge the ovaries but without making any tests or diagnosis,” he said.

The husband said after the injections, the health condition of his wife started to deteriorate but the doctor did not make any efforts to correct the situation.

“One evening my wife went into a sudden coma. I took her to a government hospital in Makkah where the doctors said she had two strokes in the brain and one in the lung,” he said.

Qabdah said his wife was put under life support systems but died after 10 days without seeing the baby she had been dreaming about all her married life.

He also took the case to the Health Ministry, which constituted an investigation committee that held the doctor responsible for the fatal mistake.

The committee found that the patient was not subjected to the necessary lab tests or X-rays and was given an overdose of the medicine.

“The doctor did not take the case seriously nor did he react to the side effects of the medicines,” the committee said holding the unidentified doctor responsible for the mistake by 100 percent.

The woman’s husband asked both the justice and health ministries to punish the doctor severely for causing the death of his wife.

He said the doctor was prevented from traveling but is still continuing his practice as usual.

    I’m sorry to say that he will hardly get any justice that will comfort him. Either they will again force him to accept the blood money or the Dr will be jailed for few months and fined for which the Dr will be happy because again he will start practicing here to earn his haram and continue his killing spree. Islam gives importance to the emotions of victims, is just and swift. The Dr has killed his patient due to his gross negligence like many of his same profession do here and roam freely. What is the punishment for such licensed killers in Sharia?

      Who are you to pass judgement on the Doctor ? Thousands die every year ,due to what is known
      as medical negligence..Surely this Doctor would have done his best,but then life and death is in
      Allah’s realm. This is actually ,the result of not accepting Allah’s decree and going in for what is
      called a “test-tube” baby ,as mentioned in this news report . Is it compliant with Shariah ?
      Now let’s see what Allah says about giving us children .

      “To Allah belongs the dominion of the heavens and the earth; He creates what he wills. He gives to whom He wills female [children], and He gives to whom He wills males.
      Or He makes them [both] males and females, and He renders whom He wills barren. Indeed, He is Knowing and Competent.” Qur’an -,49 : 50.
      As Muslims ,as believers we must accept what Allah gives and be thankful. If Allah does not ,it is in
      His infinite wisdom. We must be thankful and supplicate and be patient.”

      I state all this with the best of intentions to give him comfort ,in this time of sorrow.
      Again it is said that ,a woman who dies during childbirth, dies a martyr’s death and she gets Jennah.
      Do not lose hope after the death of your wife and sulk and think of the life before you,and who knows,Allah is waiting to give you children. Other than a woman who has to mourn for four months and ten days, for everyone else,Including husbands it is only three days.
      I ask you to forgive the doctor,since forgiving is an Attribute of Allah and there is a reward for all
      who forgive those who have wronged them. Punishing is an act of revenge and you will not get your
      wife and child. As Muslims we have to be positive,marry again and INSHA Allah, You will have the
      children you longed for. We pray that this gives you comfort in your time of sorrow.A’ameen

  2. What is the name of the so called famous clinic? What is the name of the doctor? I mean don’t you think it’s the media’s responsibility to let people know who to avoid? We don’t need reports written like a gossip..

  3. There is a clear Guidelines in the MOH and in the Judicial system to punish the responsible doctor if found guilty after proper investigation and evaluations by a special team.
    So by this time the husband has to be Patient. We pray for him and for his wife.

  4. Brother sorry for the Loss. You can’t never have Her back. You could have been patient Enough rather going to have baby through Test tube. As far as I know Test tube baby, islamically, is forbidden. May Almighty Allah forgive Her and grant her Aljannat Firdausi.Amin.

  6. this is the will of God, we cant blame any doctor or any person. God provided doctors and nurses to provide us their wise services, but there are unfortunate circumstance in some cases, we are helpless in this matter. may God console and confirm the gentleman to tolerate the irreparable loss.

  8. The ministry of health officials and the committee appointed by it must be punished because they have allowed the worthless doctor to continue practicing.

I can see there are people here looking for punishing the doctor with death penalty.If that kind of attitude continues,the day is not far when the society will beg for doctor’s services and there will be no doctors.Why would anyone enter a profession where error of judgement is punished by death.While everyone else will keep doing mistakes in their respective jobs,and remain busy in passing judgement on doctors.There are many other methods of punishment.

    Yah , true it was her time .we cant blame anyone but yah,Drs Should be careful of what dosage they are giving.
    And Brothers n sisters Test tube is allowed in Islam ,if it was not it wouldn’t have been done in Kingdom.

    • There are many things ,which are not allowed in Shariah,which are done by Saudis ,like MISYAR
      marriages,then allowing import of cigarettes and tobacco ,which according to the consensus of Scholars is Haram.!!’

      The ‘ulamaa’ in this organization – The Department of Scientific Research and Fatwaas and Da’wah in the Kingdom of Saudi Arabia – have issued fatwas stating that this is not allowed, because it involves uncovering women’s ‘awrah, touching the private parts and tampering with the uterus, even if the sperm used is that of the woman’s husband.

      In my opinion, people should accept the ruling of Allaah, may He be exalted, which is (interpretation of the meaning):

      “… and He renders barren whom He wills…” [al-Shoora 42:50].

  11. Sad, doctors and consultants must be carefully checked, they should be made to pass compulsory tests and exams every two year in order to continue practicing and to keep their degrees.

    • I disagree.. Nowhere in the world are Doctors asked to pass exams every two years.
      As a professional I wish to categorically state, that in every profession with time they gain
      experience and are able to serve better..
